Why Timing Matters So Much in Georgia
Most Georgia home loans use a security deed with a power of sale. That lets the lender foreclose without going to court, which is called non-judicial foreclosure. It's one of the quickest processes in the country.
- Federal rules generally keep a servicer from starting foreclosure until you're more than 120 days behind.
- Georgia requires a written notice of the sale at least 30 days before it happens, and the sale is advertised in the county's legal newspaper.
- Foreclosure sales are held on the first Tuesday of the month at the county courthouse.
- Georgia doesn't give homeowners a right to buy the house back after the sale.
We cover every step in detail in our guide, How Foreclosure Works in Georgia. The short version: the sooner you act, the more choices you have.
North Augusta and Aiken homeowners: South Carolina uses judicial foreclosure. The lender has to file a lawsuit, and the process usually takes longer than in Georgia. That extra time is worth using.
We're not attorneys and this isn't legal advice. If a sale date has been set, talk to a Georgia or South Carolina real estate attorney or a HUD-approved housing counselor about your exact deadlines.
Your Options to Stop or Avoid Foreclosure
- Reinstate the loan. Pay the missed payments plus late fees and costs to bring the loan current. Many loans allow this up to a point before the sale. Ask your servicer for a written reinstatement quote.
- Ask for a loan modification. The lender changes the loan terms, such as the rate or length, to make payments affordable. Send a complete application as early as you can. A complete application received more than 37 days before a sale generally means the servicer can't hold the sale while it reviews you.
- Ask for forbearance or a repayment plan. If the hardship is temporary, like a job loss or medical bills, your servicer may pause or lower payments for a while, then spread the missed amount out.
- Talk to a HUD-approved housing counselor. They're free, and they can help you understand your options and talk to your servicer. Find one at hud.gov/findacounselor or call 800-569-4287. Be wary of anyone who asks for an upfront fee to "save" your house.
- Sell before the sale date. If you have equity, selling pays off the loan and puts the rest in your pocket, instead of losing it at the courthouse. It also avoids a completed foreclosure on your record.
- Short sale or deed in lieu. If you owe more than the house is worth, the lender may accept less than the full payoff, or take the house back without a foreclosure sale.
