How Selling an Inherited House Usually Works

  1. Find out who has authority to sell. If there's a will, it usually names an executor. If there isn't, the probate court appoints an administrator. Either way, the court issues "letters" that give that person the power to act for the estate.
  2. Open probate in the right county. The estate goes through the probate court in the county where the person lived: Richmond County Probate Court in Augusta, Columbia County Probate Court in Appling, or Aiken County Probate Court in Aiken for South Carolina homes.
  3. Get permission to sell, if needed. Many Georgia wills let the executor sell without a court order. If not, your attorney asks the court for leave to sell. We can sign an agreement while that's in process.
  4. Close and distribute. At closing, any mortgage, liens and back taxes are paid, and the rest goes to the estate to be divided among the heirs.

We're not attorneys and this isn't legal advice. Every estate is different, so talk to a Georgia or South Carolina probate attorney about yours. We're happy to work alongside them.

Why Families Sell Inherited Houses to Us

  • The house is full. Decades of belongings don't have to be sorted, sold or hauled off. Keep what matters and leave the rest.
  • It needs work. Older homes often need a roof, HVAC, plumbing or updates before they'd sell on the market. We buy as-is.
  • The heirs live elsewhere. Nobody has to travel back to manage contractors and showings, and signing can be done remotely.
  • Costs keep adding up. Taxes, insurance, utilities and lawn care on an empty house add up every month. A quick sale stops that.
  • Everyone gets a clear number. A cash offer with no repair requests or financing contingencies makes it easier for several heirs to agree.

Some inherited land and houses in the CSRA are heirs' property, passed down without a will over several generations. We buy those too. See how we buy land, including heirs' property.

What Families Have Said

“It was so easy to work with Jeremy, I kept wondering what the catch was… there was no catch! Selling my house this way was especially pain free for me, having just inherited a home and going through the grieving process.”

Valene Webb, Google review

“My family sold our father's home to Jeremy with CSRA Homebuyers. He gave us a great price and was kind, compassionate, and patient throughout the whole process.”

Inherited House Questions

Can I sell an inherited house before probate is finished?

Often the sale can be agreed while the estate is still open, and it closes once the executor or administrator has the authority to sell. Nobody can sign a deed for the estate until the probate court has issued letters to the personal representative, so that is usually the first step.

Who signs to sell the house?

Usually the executor named in the will, or the administrator the court appoints if there's no will. In some cases, such as when no probate is opened, all of the legal heirs may need to sign. A probate attorney can tell you which applies to your family.

Does the court have to approve the sale?

It depends on the will and the type of appointment. Many Georgia wills give the executor the power to sell without a separate court order. If there's no will, or the will doesn't grant that power, the personal representative usually asks the probate court for permission first. Your attorney can confirm.

Do we have to clean out the house first?

No. Take the photos, keepsakes and furniture you want, and leave the rest. We handle the cleanout after closing, at no cost to the family.

What if there's still a mortgage or back taxes on the house?

Those are paid out of the sale at closing. The remaining money goes to the estate, to be divided the way the will or Georgia law says.

Is selling an inherited house taxable?

Inherited property generally gets a stepped-up cost basis, which often means little or no capital gains tax if you sell soon. Everyone's situation is different, so check with a CPA or tax preparer.

Where We Buy Inherited Houses

We buy inherited houses in Augusta, Evans, Martinez, Grovetown, North Augusta, Aiken and the rest of the CSRA. If the house is also behind on property taxes, that can be handled at closing too.
